1. Introduction and Acceptance

Welcome to FinSeas ("App," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our mobile application.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Age Requirement

You must be at least 16 years old to use this App. By using the App, you represent that you meet this age requirement.

2. License to Use

2.1 Grant of License

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use, subject to these Terms.

2.2 Restrictions

You agree NOT to:

• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices

2.3 Intellectual Property

The App and all content, features, and functionality are owned by FinSeas and protected by copyright, trademark, and other intellectual property laws.

3. User Accounts

3.1 Account Creation

To use certain features of the App, you must create an account by signing in with Google OAuth. You agree to:

• Provide accurate and complete information
• Maintain the security of your account
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

3.2 Google OAuth

By signing in with Google, you agree to Google's Terms of Service and grant us access to the information you authorize through Google OAuth as described in our Privacy Policy.

3.3 Account Termination by User

You may delete your account at any time through the App's profile or settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable laws or regulations
• Infringe on any third party's intellectual property rights
• Transmit any harmful or malicious code
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Interfere with or disrupt the App's functionality

5. Prohibited Conduct

The following activities are strictly prohibited:

• Using the App to harm minors
• Attempting to gain unauthorized access to the App or related systems
• Collecting or harvesting user information without consent
• Using automated systems (bots, scrapers) without permission
• Uploading viruses or malicious code
• Engaging in any activity that could damage, disable, or impair the App

Violation of these prohibitions may result in immediate account termination and legal action.

6. User-Generated Content

6.1 Content Ownership

You retain ownership of any content you create, upload, or submit through the App ("User Content").

6.2 License Grant

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of operating and improving the App.

6.3 Content Responsibility

You are solely responsible for your User Content. You represent that you own or have the right to use your User Content, that it does not violate any laws or third-party rights, and that it does not contain harmful or offensive material.

6.4 Content Removal

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, without notice.

7. Termination

7.1 Termination by Us

We may suspend or terminate your access to the App at any time, without notice, for violation of these Terms, fraudulent or illegal activity, extended periods of inactivity, or any other reason at our discretion.

7.2 Effect of Termination

Upon termination, your right to use the App immediately ceases, you must delete the App from all devices, and provisions of these Terms that should survive termination will remain in effect.

8. Payment Terms

FinSeas may offer optional paid features in the future. If and when we do, pricing, subscriptions, and refunds will be described in the App and governed by the respective app store (Apple App Store / Google Play) policies.

9. Disclaimers

9.1 "AS IS" and "AS AVAILABLE"

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9.2 No Professional Advice

The App does not provide professional financial, tax, or legal advice. Any information provided is for general informational purposes only.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability for any claims related to the App shall not exceed the amount you paid us in the twelve (12) months before the claim arose, or USD $100, whichever is greater.
• We shall not be liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, data, or goodwill, service interruptions or data loss, or third-party actions or content.
• You assume all responsibility for your selection and use of the App and results obtained from use.

11. Indemnification

You agree to indemnify, defend, and hold harmless FinSeas, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from your use of the App, your violation of these Terms, your violation of any third-party rights, or your User Content.

12. Third-Party Services

The App may contain links to or integrate with third-party services (e.g., Google OAuth). We are not responsible for the content or practices of third-party services, any transactions between you and third parties, or third-party terms or policies. You should review the terms and policies of any third-party services you access through the App.

13. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to our collection and use of information as described in the Privacy Policy.

14. Governing Law and Disputes

14.1 Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes arising from these Terms or the App shall be resolved through good faith negotiation and, if necessary, the courts of competent jurisdiction.

14.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions or class arbitrations.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date, posting a notice in the App, or sending an email if provided. Your continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App.

16. General Provisions

These Terms constitute the entire agreement between you and us regarding the App. If any provision is found invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not constitute a waiver. You may not assign these Terms; we may assign them to any successor or affiliate. We are not liable for delays or failures due to circumstances beyond our reasonable control.
